Terms of Service

Welcome to Execord. By inviting the Execord bot to your Discord server or using its features, you agree to these Terms of Service.

1. Scope & Service Description

Execord is an AI-powered Discord automation tool designed to translate natural language prompts into administrative Discord actions (such as managing channels, roles, and server settings). The service is provided on a software-as-a-service basis.

2. User Responsibilities & Fair Use

By using Execord, you agree to the following obligations:

• Authorization: You must have appropriate administrator rights on the Discord server where you execute commands.
• Verification of AI Actions: Because large language models operate probabilistically, you are responsible for supervising bot actions and reviewing generated plans before executing impactful server modifications.
• Prohibited Conduct: You agree not to attempt prompt injections to bypass security controls, intentionally exploit bugs, reverse engineer the pipeline, or use the bot in violation of Discord's Terms of Service.

3. Subscriptions & Payments (Whop as Merchant of Record)

Paid tiers (such as Pro or Ultra plans) and bonus token packages are processed via Whop Inc. acting as the Merchant of Record. Whop handles the checkout, invoicing, recurring billing, applicable sales taxes, and payment processing. Subscription cancellations and refund inquiries are managed directly through your Whop account dashboard.

4. Availability & Maintenance

We strive to maintain high availability, but do not guarantee uninterrupted 100% uptime. Temporary downtime may occur due to scheduled maintenance or third-party outages (such as Discord API disruptions or AI provider latency).

5. Limitation of Liability

To the maximum extent permitted by applicable law:

• Execord is liable without limitation for intent (Vorsatz), gross negligence (grobe Fahrlässigkeit), and damages resulting from injury to life, body, or health.
• In cases of slight negligence, Execord is only liable for breaches of material contractual obligations (cardinal duties), limited to typically foreseeable damages at the time of contract conclusion.
• Execord is not liable for data loss or unintended server changes arising from unauthorized third-party actions or failure of server administrators to review bot commands.

6. Termination & Blacklisting

You may terminate your use of Execord at any time by removing the bot from your server. We reserve the right to temporarily suspend or permanently blacklist any user or guild that repeatedly abuses the service, exploits vulnerabilities, or violates these Terms.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles.
